1. Acceptance of Terms

EMG Quantum provides its services to you, subject to the following Terms and Conditions (T&C), which may be updated by us from time to time without notice to you. By accessing and using the EMG Quantum platform, you accept and agree to be bound by these T&C.

2. Description of Service

EMG Quantum offers digital marketing and CRM solutions, including but not limited to email marketing, social media management, customer relationship management (CRM), and analytics services. Users are responsible for obtaining access to the Service, which may involve third-party fees (such as Internet service provider or airtime charges).

3. Privacy Policy

Our Privacy Policy, incorporated by reference into these T&C, explains how we collect, use, and disclose information that pertains to your privacy. By using our service, you consent to the collection and use of this information as outlined in our Privacy Policy.

4. User Conduct

Users agree not to use the service to: (a) transmit spam or unsolicited messages; (b) impersonate any person or entity; (c) upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.

5. Intellectual Property Rights

You acknowledge that EMG Quantum owns all rights, titles, and interests in and to the service and content provided through the service, including all intellectual property rights.

6. User-Generated Content

You grant EMG Quantum a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the service.

7. Termination

EMG Quantum may terminate your access to all or any part of the service at any time, with or without cause, with or without notice, effective immediately.

8. Warranties and Disclaimers

The service is provided "as is". EMG Quantum and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement.

9. Limitation of Liability

In no event will EMG Quantum, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (a) any special, incidental or consequential damages; (b) the cost of procurement for substitute products or services.

10. General Representation and Warranty

You represent and warrant that your use of the service will be in strict accordance with the EMG Quantum Privacy Policy, with these T&C, and with all applicable laws and regulations.

11. Indemnification

You agree to indemnify and hold harmless EMG Quantum, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the service, including but not limited to your violation of this Agreement.

12. Miscellaneous

These T&C constitute the entire agreement between EMG Quantum and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of EMG Quantum, or by the posting by EMG Quantum of a revised version.

By using EMG Quantum, you agree to be bound by these terms and conditions.

13. Cancellation Policy

Monthly and Annual Subscriptions

EMG Quantum offers both monthly and annual subscription options. Subscribers can cancel their subscription at any time.

Cancellation Process

To cancel your subscription, you must notify EMG Quantum before the end of your current subscription term. You can initiate the cancellation process through your account settings on the EMG Quantum platform or by contacting our customer support team directly.

Effect of Cancellation

Upon cancellation, your subscription will remain active until the end of the current billing cycle. You will not be charged for the next billing cycle after your cancellation is processed. Access to premium features will continue until the end of the current subscription term.

No Refunds

Please note that EMG Quantum does not provide refunds for any remaining time in your subscription period upon cancellation. We encourage subscribers to consider their decision to cancel carefully and to utilize their subscription fully until the end of the term.

Renewal

Your subscription will automatically renew at the end of each subscription term unless you cancel your subscription before the renewal date. EMG Quantum will provide a reminder before your subscription is due to renew.

Changes to Cancellation Policy

EMG Quantum reserves the right to modify or update this cancellation policy at any time. Subscribers will be notified of any significant changes to the policy.

By subscribing to EMG Quantum, you agree to this cancellation policy as part of the Terms and Conditions of your use of our services.
